Terms of Service

1. Acceptance of Terms
By installing, accessing, or using A11yMate (the “Service”), including the Chrome extension, the web dashboard, the public API, and any associated documentation or content, you agree to be bound by these Terms of Service (the “Terms”). If you do not agree to these Terms, you must not use the Service.
You must be at least 13 years of age to use the Service. If you are located in the European Economic Area (EEA), you must be at least 16 years of age. By using the Service, you represent and warrant that you meet the applicable age requirement.
2. Description of Service
A11yMate is an accessibility testing platform that helps developers, designers, and organizations identify and remediate WCAG 2.2 accessibility violations. The Service includes:
- A Chrome browser extension that scans web pages for WCAG 2.2 Level AA violations using the axe-core engine, with fix guides, color-blindness simulation, and a manual accessibility checklist.
- A web dashboard for managing scan reports, viewing history, sharing results, and tracking violation statuses.
- A GitHub Action for automated CI/CD accessibility testing.
- Free and paid tiers with varying features, as described in Section 3 below.
3. Plans and Pricing
A11yMate offers the following plans:
3.1 Free Plan — $0
Unlimited scans, fix guides with code examples, color-blindness simulator, manual accessibility checklist, and CSV export.
3.2 Pro Plan — $9.99/month
Everything in Free, plus AI-powered fix suggestions, PDF report generation, auto-generated VPAT documents, scan history, report sharing, and an accessibility score badge.
3.3 Team Plan — $29/month
Everything in Pro, plus up to 15 team members with shared dashboard access and violation status tracking across team members.
3.4 Agency Plan — $49/month
Everything in Team, plus unlimited team members, white-label report exports (A11yMate branding removed), and public API access for programmatic integrations.
3.5 Billing and Subscriptions
All paid subscriptions are billed monthly through Lemon Squeezy, our payment processor.
- Auto-renewal: Subscriptions automatically renew each billing cycle until canceled. You authorize recurring monthly charges to your payment method on file.
- Cancellation: You may cancel your subscription at any time through the Lemon Squeezy customer portal. Cancellation takes effect at the end of the current billing period; you will retain access to paid features until that date.
- Refund policy: No refunds are provided for partial billing periods. However, if you cancel within 14 days of your first payment and have not used Pro-tier features extensively, you may contact us for a full refund.
- Downgrade: When downgrading to a lower-tier plan, you retain access to the higher-tier features until the end of the current billing period. Existing data (reports, settings) is preserved, but features exclusive to the higher-tier plan become inaccessible after downgrade takes effect.
- Price changes: We will communicate any price changes at least 30 days in advance. Price changes take effect at the start of your next billing cycle following the notice period.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable local, state, national, or international law
- Reverse-engineer, decompile, or disassemble any part of the Service beyond what is expressly permitted by applicable law
- Abuse or exceed API rate limits, or attempt to interfere with the proper functioning of the Service
- Submit false, misleading, or fraudulent information to the Service
- Use automated tools, bots, or scrapers to access or interact with the Service beyond the provided API
- Redistribute, resell, or sublicense the Service without prior written permission (except as permitted under the Agency plan)
- Remove or modify any copyright, trademark, or attribution notices in the Service
We reserve the right to suspend or terminate access for accounts that violate these terms, as described in Section 10 below.
5. Accuracy Disclaimers
5a. Automated Testing Limitations
A11yMate uses the axe-core engine, which detects approximately 30–57% of WCAG violations through automated testing. A passing scan does NOT mean a website is fully WCAG compliant. Automated testing cannot replace manual accessibility testing and expert evaluation. The accessibility score provided by A11yMate is a measure of automated test results only and does not constitute a compliance certification of any kind.
5b. AI-Generated Content Disclaimer
AI fix suggestions are generated by OpenAI GPT-4o-mini and may contain errors, inaccuracies, or incomplete solutions. AI-generated code should be reviewed by a qualified developer before implementation. AI suggestions may not fully resolve the accessibility issue they target and could potentially introduce new issues if applied without review. A11yMate is not responsible for any consequences arising from the implementation of AI-generated code suggestions.
5c. VPAT Auto-Generation Disclaimer
VPAT (Voluntary Product Accessibility Template) documents generated by A11yMate are based on automated scanning results and manual checklist inputs. Auto-generated VPATs are NOT a substitute for professional accessibility audits. Auto-generated VPATs should be reviewed and validated by a qualified accessibility evaluator before use in procurement, legal, or compliance contexts.
A11yMate auto-generated VPATs do not constitute legal advice, professional certification, or official compliance documentation. A11yMate is not responsible for any consequences arising from the use of auto-generated VPATs in government procurement, legal proceedings, or compliance submissions. The conformance levels determined by A11yMate are based on available test data and may not reflect the true conformance state of the evaluated product.
5d. Accessibility Badge Disclaimer
The accessibility score badge reflects automated test results only. Displaying the badge does not constitute a certification of accessibility compliance. The badge shows a point-in-time score and may not reflect the current state of the website.
5e. Blog Content Disclaimer
Blog posts published on the A11yMate website are for informational purposes only and do not constitute legal advice. Information about the ADA, Section 508, EAA, and other accessibility regulations may change over time. Consult a qualified attorney for legal advice specific to your situation.
6. Intellectual Property
All software, design, branding, and content of A11yMate are proprietary and protected by applicable intellectual property laws.
- User content: You retain full ownership of your scan reports, uploaded content, and data generated through your use of the Service.
- Aggregate data: A11yMate may use aggregate, anonymized data derived from Service usage for the purpose of improving the Service. Such data will not identify you or your scanned websites.
- AI-generated content: AI fix suggestions and AI-generated VPAT remarks are provided under a non-exclusive, royalty-free license for your use in connection with the accessibility issues they address.
- White-label (Agency plan): Agency plan users may use white-label report exports in client deliverables with A11yMate branding removed.
- Open-source components: A11yMate uses the axe-core engine under the Mozilla Public License 2.0.
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. You are responsible for the data you scan and share through the Service. You should not scan websites that you do not own or do not have authorization to test.
8. Indemnification
You agree to indemnify, defend, and hold harmless A11yMate and its operators, affiliates, officers, and employees from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from or related to:
- Your use of the Service
- Your submission of auto-generated VPATs or reports to third parties, including in procurement, legal, or compliance contexts
- Your implementation of AI-generated code suggestions
- Your violation of these Terms
- Your scanning of websites without proper authorization
9. Limitation of Liability
The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, A11yMate's total aggregate liability for any claims arising out of or related to the Service shall not exceed the total amount you paid to A11yMate in the twelve (12) months immediately preceding the event giving rise to the claim.
In no event shall A11yMate or its operators be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity arising from:
- Your use of or inability to use the Service
- Errors or omissions in scan results
- Accessibility compliance decisions made based on data produced by the Service
- Implementation of AI-generated fix suggestions
- Use of auto-generated VPATs in procurement or compliance contexts
- Incompatibility with specific websites or browser versions
- Service interruptions, feature changes, or data loss
This limitation of liability applies to the fullest extent permitted by law, regardless of the legal theory upon which the claim is based.
10. Account Termination
- You may delete your account at any time through the dashboard settings.
- We may suspend or terminate accounts that violate these Terms, with or without prior notice depending on the severity of the violation.
- Upon termination, active subscriptions will not be refunded for the remaining portion of the current billing period.
- You may export your data before account deletion. We recommend downloading your scan reports and any other data you wish to retain prior to initiating deletion.
- We will delete your personal data within 30 days of account deletion, except where retention is required by applicable law.
11. API Terms (Agency Plan)
The following additional terms apply to users of the A11yMate public API, which is available exclusively under the Agency plan:
- API keys are confidential credentials. You are responsible for safeguarding your API keys and must not share them with unauthorized parties.
- Rate limits apply to API usage and are published separately. We reserve the right to throttle or suspend API access for accounts that exceed rate limits or engage in abusive patterns.
- White-label rights: Agency plan users may remove A11yMate branding from exported reports and use them in client deliverables.
- Resale: Agency plan users may resell reports to their clients but remain solely responsible for communicating the accuracy disclaimers described in Section 5 of these Terms.
12. Chrome Web Store
A11yMate is distributed through the Chrome Web Store. Your use of the Chrome Web Store is also subject to Google's Terms of Service.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.
For users in the European Union or European Economic Area, your rights under the General Data Protection Regulation (GDPR) and other applicable EU/EEA laws are preserved regardless of the governing law provision above.
In the event of a dispute, the parties agree to first attempt resolution through good-faith negotiation for a period of at least 30 days. If the dispute cannot be resolved through negotiation, it shall be resolved through binding arbitration or litigation in the courts of the State of California.
14. Changes to Terms
We may update these Terms from time to time. We will provide at least 30 days' notice before material changes take effect. Notice will be provided by posting the updated Terms on this page with a revised “Last updated” date, and material changes will also be communicated via email to the address associated with your account.
Continued use of the Service after the notice period constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service before the changes take effect.
